West Bengal's real estate projects are regulated by HIRA, the state's RERA authority. Any project above 500 square metres or with more than eight apartments must be registered before it can be advertised or sold, and the developer is required to keep 70% of buyer payments in a separate escrow account used only for that project's construction, which is meant to stop funds from being diverted elsewhere.

If a registered project is delayed beyond its promised date, buyers are generally entitled to either a full refund with interest or continued compensation until possession, and complaints against a developer or agent can be filed directly with HIRA, which is meant to resolve them within about 60 days rather than leaving you to a lengthy civil suit.

On the rental side, the direction of reform is similar: a shift toward written, registered tenancy agreements, capped security deposits, and advance written notice before any rent increase, replacing the informal, verbal arrangements that used to cause most landlord-tenant disputes.

Whatever the transaction, the paperwork that actually protects you is the same: a verified title, an encumbrance certificate confirming the property is free of loans or legal claims, the sanctioned building plan, and, for new projects, a valid RERA/HIRA registration number.
